Cycle of Samsara (the brand) provides a curated, peer-to-peer marketplace for buying and selling pre-loved/pre-owned fashion. By accessing or using our platform, you agree to these Terms and Conditions. Please read them carefully.

LET'S GET STARTED WITH THE BASICS

1. About You and Us

Who We Are

Hey there! We're Cycle of Samsara, a Unit of Styleise Outfiters LLP. Cycle of Samsara (referred to as "we," "us," or "our") offers a marketplace where registered users can list, buy, and sell second-hand fashion items. We aim to facilitate a trusted and sustainable shopping experience using our professional and expert knowledge.

What we do

We own and manage websites, applications, and other platforms (altogether, our Site) where we provide the following Services:

  • Hosting: Acting as an intermediary between Buyers and Sellers. We don't buy or sell Items on the Catalogue and are not a party to any Transactions. We only connect the buyers with the sellers and vice versa
  • Buyer Protection: We charge a fee for every Transaction, ensuring that payments are made safely and allowing Buyers to get a refund if their Item is lost, damaged, or does not match the description. Our customer support team provides the necessary support with regard to the above.
  • Optional Services: We provide additional services for Buyers and Sellers as described further in these Terms.

We are responsible for the Services we provide within the limits of applicable laws, our commitments, and under the conditions set out in the Terms and Conditions as provided herein.

About you and our Users

To qualify to be one of our users, you are required to:

  • To have attained at least 18 years of age.
  • Have opened an account with us.
  • Intend to use our Services for your personal use and benefit only.
  • Have the capacity and rights to carry out Transactions on the Site.
  • Agrees to the Terms and Conditions and the rules contained herein.

Your choice to buy and sell

Users can be:

  • A Seller, who lists goods and items for sale (Each and Every Item) on the electronic Catalogue on our Site.
  • A Buyer, who views, searches, and buys an Item or multiple Items as part of a bundle by clicking the buy button, provides for payment details, and makes payment by clicking on the "Pay" button to complete a Transaction.

About these Terms

These Terms and Conditions (the Terms) are a legal agreement between you and us and governs your use of our Site and Services. You agree to these Terms by clicking the button indicating your acceptance while registering for a personal account with us (an Account) or when notified of updates to these Terms.

Other important information

We provide links to important information in these Terms, including our Help Centre, where you'll find answers to frequently asked questions (FAQ). If you can't find what you're looking for, feel free to reach out to us using the methods below.

Privacy policy

Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our services, you agree to the terms.

4. Becoming Our User

a) Curated Listings

We reserve our right to accept or reject listings as buyer/seller as ours is a curated platform. To improve your chances of selling, we may suggest changes to your listing so as to make it more defined.

b) Account Registration

To use our platform, you must register for an account.

  • Each user can only have one account.
  • You are responsible for maintaining the confidentiality of your login details.
  • All activity conducted through your account would be your sole responsibility.

How to create an Account

To create your Account and keep it secure, you'll need to:

  • Provide a valid email and choose a unique username and password.
  • Avoid using disposable or masked emails, as these are not allowed.

Verification and Security Actions

During registration or while using our Services, we may ask you to:

  • Verify your account information (e.g., phone number, email, or payment method).
  • Provide additional relevant information or update incorrect details.
  • Provide social media links (e.g., Instagram, Facebook, X, YouTube) to prevent spam accounts.

The requests would be proportionate to the security concern we are addressing. Failure to provide the required information may result in corrective measures or blocking of the account.

Account Restrictions

  • Users can have only one account. If your account is unlawfully accessed or blocked, you may create a new account.
  • If we block your account for rule violations, creating a new account would not be allowed.

Promotions

We may notify you of promotions, such as special offers, competitions, or discounts, depending on your eligibility. Some features may be temporarily altered during a promotion.

Third-party Websites and Content

Certain features on our Site may use tools and services provided by third parties. Your use of these features will be governed by their terms and conditions, which we will provide for your review.

Presentation of Information

To enhance your experience, we may reorganize the Catalogue or advertising spaces on the Site. These changes will not affect the Content you provide or our obligations under these Terms.

5. Using Information You Share with Us

How we use your personal data

We will process your personal data to fulfill our obligations and rights under these Terms and provide you with our Services. While we implement robust security measures to protect your data, we cannot guarantee complete protection against cyber attacks or unauthorized access by third parties. Please consider the personal data or information you provide us as being at your own risk.

How we can use your Content

To the extent permitted by law, you grant COS us and our affiliates a non-exclusive, worldwide, and royalty-free license to use your Content during the applicable rights' duration. This allows us to:

  • Copy, display, and adapt your Content for operational, commercial, and advertising purposes.
  • Use your Content on any type of platform or media, including television, print media, the Internet (e.g., banners and articles), and social networks (e.g., Facebook, X, Instagram).
  • Users retain ownership of content they upload but grant us a non-exclusive, royalty-free license to display and distribute this content. Prohibited content includes, but is not limited to, illegal, defamatory, or misleading material.

You may opt out of our use of your Content for advertising purposes by adjusting your Account settings.

6. What You Must and Must Not Do

You must:

To ensure a safe and trusted environment for all Users on our site, you agree to:

  • Comply with these Terms and applicable laws.
  • Provide truthful, accurate, and up-to-date information, and update your Account details if any changes occur (e.g., address).
  • Keep your Account login details and password confidential, and notify us if you suspect unauthorized access.
  • Only share information from the Site using the "Share" button, if applicable.
  • Be responsible for the rights and accuracy of all information, photographs, or data you upload (your Content).

You must not:

When creating an Account or using the Site or Services, you agree not to:

  • Engage in illegal, unethical, or harmful activities that may infringe on our or other Users.
  • Use unauthorized software tools (e.g., bots, scraping programs, spiders) for promoting Items, adding to favorites, or other activities.
  • Disrupt the operation of the Site or Services, or use software that could harm other Users' devices.
  • Adapt, copy, edit, or distribute Site content without our prior consent.
  • Mine data, screen scrape, reverse engineer, or decompile any part of the Site.
  • Publish or upload Content that promotes hate speech, violence, terrorism, organized crime, or other illegal activities.
  • Delete and re-list Items repeatedly to manipulate rankings or visibility.
  • Collect, hold, or disclose information obtained unlawfully about other Users or their Content.
  • Advertise other websites or companies on the Site.

7. Our Rights to Handle Concerns

Taking corrective actions

If we find you in violation of these Terms or engaged in unlawful activities, we reserve the right to:

  • Send a warning requesting compliance with these Terms.
  • Remove or correct your Items in the Catalogue.
  • Demote, hide, or remove your Content from the Site.
  • Restrict your Account by blocking features (e.g., messaging or item visibility).
  • Notify local authorities if there's a threat to life or safety.

Blocking your Account

We may temporarily or permanently block your Account if:

  • You repeatedly breach these Terms after corrective action.
  • You commit a serious breach, such as:
    • Providing false or misleading information.
    • Failing to cooperate during information verification.
    • Abusing Site functionalities.
  • You violate security protocols or are involved in suspicious activities flagged by payment providers.

If your Account is blocked:

  • You cannot use the Site except to contact Customer Support.
  • Your Items will be removed from the Catalogue.
  • No refunds will be provided for unused Seller Services.
  • Pending Transactions may be cancelled, and Buyers refunded.

8. How to Set Up a Wallet on our site (Wallet Balance)

About COS Wallets

The Wallet is an electronic wallet that you can use to:

  • Receive and store funds from sold Items.
  • Buy Items using wallet funds.
  • Transfer wallet funds to your personal bank account (Payouts).
  • Purchase optional Services on the platform.

Who needs a Wallet?

  • Any User can set up a Wallet.
  • Sellers are required to create a Wallet within 5 calendar days of making their first sale.

How to open a Wallet

To open a Wallet:

  1. Go to your Account, select "Profile," and press "Wallet"
  2. Provide your full name, address, and other necessary information.
  3. Agree to the Wallet Provider's terms and conditions, as well as their privacy policy.

Failure to open a wallet within 5 days of making a sale will result in the cancellation of the Transaction.

9. How to Make Payments

How to pay on our Site

We aim to make paying for Items or purchasing our Services as simple as possible. You can make a payment using:

  • Your Wallet: If you have funds in your COS Wallet, they will automatically be used as the primary payment method. If the funds are insufficient, you can complete the payment with another method.
  • UPI, credit card, or debit card.
  • Other payment methods: We may introduce additional payment options on our Site in the future.

Processing your payment

We work with authorized third-party payment service providers (Payment Processors) to:

  • Process online payments for Items or optional services purchased on our Site.
  • Process Payouts from your Wallet.
  • In some cases, provide COS Wallet services (acting as Wallet Provider).

We also work with third-party providers to securely store your payment method information. While we facilitate payments through Payment Processors, do not directly handle or store your payments.

Holding money securely

When you purchase an Item:

  • All money you pay will be held in a separate Escrow account managed by ourWallet Provider until the Transaction is completed.
  • After the Transaction is completed, the Item price and any shipping costs (excluding Prepaid Shipping fees) will be released to the Seller's Wallet.

Safety and security

To ensure the safety of your payments:

  • Verify the accuracy of your payment details.
  • Be prepared to provide proof of ownership for a payment method if flagged by automated systems.
  • Payments suspected of being unauthorized or fraudulent may be cancelled.

10. Sending Messages and Leaving Reviews

Private messages

Users can exchange private messages to discuss details about an Item. However, private messages must not be used for:

  • Advertising.
  • Sharing personal data.
  • Sending malware or harmful links.
  • Sending unsolicited or mass messages to 5 or more Users.
  • Sending illegal, obscene, or harmful messages that violate public security or ourbest interests.

Leaving a review

After a Transaction is completed, you can write and publish a review about the Transaction and the other User. Please note:

  • Reviews must be fair and honest.
  • We do not compensate Users for leaving reviews.
  • Reviews are published without prior verification or moderation by us.

Every Completed Sale Requires a Review

Mandatory Reviews

  • Buyers must submit a review within 3 days of confirming receipt of an item.
  • If no review is submitted, the system will automatically assign a 5-star review to the Transaction.

Negative Reviews for Incomplete Sales

  • Buyers may leave a negative review if the Seller fails to complete the sale (e.g., by not shipping the item).

Display of Reviews

  • Reviews will appear on both the buyer's and seller's profiles to promote transparency and accountability.

Review Editing

  • Once submitted, reviews cannot be edited or deleted by the buyer.

11. Ending Our Relationship

You can end our relationship

You may terminate your relationship with us and stop using our Services at any time, free of charge, by:

  • Deleting your Account.
  • Contacting us via email to request Account deletion.

Or we can

We reserve the right to terminate these Terms for any reason by providing 15 days' prior written notice.

What happens next

Even after termination, these Terms will remain in effect until any pending Transactions and Payouts are completed.

12. Selling an Item on our site

What you can sell

When listing an Item for sale on our site, you must:

  • Have the legal right to transfer ownership of the Item to a Buyer.
  • Ensure the Item complies with our Rules and any restrictions or prohibited item requirements set by the Payment Processor.

Listing an Item for sale

To list an Item on our site:

  1. Upload at least two photos: The photos must accurately represent the Item's quality and appearance, including any defects or alterations. Photos must not be taken from the Internet.
  2. Provide a truthful description: The description must detail the Item's condition and include all necessary information to help Buyers to take informed decisions.

Once your listing is submitted, it will be reviewed by our admin team. After approval, the Item will appear in the Catalogue, making it available for Buyers to view and purchase. By listing an Item, you officially offer it for sale, which can be accepted by a Buyer.

  • A Buyer has the option to decide not to proceed with the purchase
  • An Item is officially sold only after the Buyer clicks the buying button and their payment is processed.

Withdrawing your listing

You can withdraw your Item listing at any time before a Buyer makes a purchase.

How we Help to Rank and to Recommend Your Listings

We use automated tools to rank and recommend relevant Items to Users browsing the Site. Factors influencing recommendations may include Item quality, price, and Buyer preferences.

Sellers' Responsibilities

Truthful descriptions and clear photos

Sellers must ensure that:

  • Listings include accurate descriptions of the Item.
  • Each listing contains a minimum of two clear, original images.

Luxury and high-value items

  • Items classified as luxury or high-value undergo a verification process for authenticity.
  • Buyers may choose to add authentication services for these Items at an additional cost.
  • While we strive to ensure the authenticity of listed products, the final responsibility lies with the seller. Buyers should review authentication certificates where provided.

Shipping timeline

Sellers must ship sold Items within 5 calendar days of sale confirmation.

We charge a flat commission rate of 25% on all products, regardless of their listed price.

Vacation Mode

Sellers can activate Vacation Mode to:

  • Temporarily hide their listings.
  • Prevent purchases when unavailable to fulfill orders.

13. Buying an Item

How to buy an Item

To purchase an Item from the Catalogue, follow these steps:

  1. Click the buying button on the Item page.
  2. Select a payment method and a delivery option.
  3. Click the paying button on the checkout page to complete your purchase.

How much you'll pay

For every Transaction, you will pay the following fees, which will be held in Escrow until the Transaction is completed:

  • Item price.
  • Shipping fee.
  • Buyer Protection fee.
  • Optional service fees, such as authentication, if applicable.

What happens next?

  • We will receive updates from the carrier and notify you when the Item should have been delivered (or if the Item appears to be lost).
  • For further details, refer to the chapter on Buyer Protection.

If you buy an Item outside of our Site

We are not responsible for transactions that occur offline or outside the platform. These purchases are made at your own risk and are not covered by the protections we offers for on-site Transactions.

Buyers' Responsibilities

  • Carefully review item descriptions, photos, and details before making a purchase.
  • Process payments exclusively through COS's secure payment system.
  • Avoid exchanging personal information outside the platform.
  • Use our Buyer Protection to safeguard your purchases.

In the event of disputes, our team will assist in resolving the issue.

14. Buyer Protection

Purpose of Buyer Protection

Buyer Protection provides a refund policy in case:

  • An Item is lost during shipping.
  • An Item is damaged during shipping.
  • An Item is significantly not as described.
  • An Item, claimed to be original, turns out to be counterfeit.

Customer Support will assist you during this process based on our Refund Policy. Your payment will remain in Escrow until the Transaction is marked as completed.

Note: Buyer Protection is not insurance or a legal protection service. It is an additional service that complements your legal rights and guarantees. A Buyer Protection fee is charged for every purchase made using the buying button.

Refund Policy

You are eligible for a refund if:

  • The Item is confirmed as lost or damaged during shipping.
  • The Item differs significantly from its description (e.g., incorrect size, color, severe damage like stains or holes).
  • The Item is found to be counterfeit after claiming to be original.

What to do if there are issues with your Item

  1. Report the issue: Click the "I have an issue" button in your private message screen within 5 calendar days of receiving the Item or the delivery notice. This will suspend the Transaction, and the funds will remain in Escrow until the issue is resolved.
  2. Missed reporting period: If you do not report the issue within the Refund Request Period, the Transaction will automatically be marked as completed.

If an issue is escalated to us

  • We will review the case, including evidence from both the Buyer and Seller.
  • The final decision on eligibility for a refund will be made by us, and both parties must respect such decision.

When refunds are not available

You will not be eligible for a refund if you:

  • Claim the Item is counterfeit, but it is detected to be genuine.
  • Confirmed the Item was acceptable when received.
  • Failed to report the issue within the Refund Request Period.
  • Did not provide evidence to Customer Support within specified timelines.
  • Used, washed, or altered the Item before returning it.
  • Are under investigation for abusing or misusing the Buyer Protection service.

What type of refund you can get

Refunds will cover fees paid for the Item's value. However, we shall not refund:

  • The platform fee.
  • Shipping fees.
  • Buyer Protection fees.
  • Any fees for value-added services.

Returns Policy

Eligibility for Returns

Returns are accepted only if:

  • The Item significantly differs from its description.
  • The Item fails our authentication process.

Non-Returnable Items

Returns are not accepted for:

  • Sizing issues or changes in personal preference.
  • Buyer's change of mind after purchase.

Return Process

  1. Buyers must submit a return request.
  2. If the Seller accepts the return, the process will proceed.
  3. If the Seller disputes the return, we will review evidence from both parties and make the final decision.

WHAT ELSE DO WE OFFER?

15. Optional Services for Sellers

Seller Services

Sellers can choose to purchase optional services (Seller Services) described in the Help Centre for additional fees.

  • Each Seller Service is a single-use automated service and is not transferable between Items or Users.
  • We shall inform you of the cost and duration of a Seller Service before purchase.
  • After purchasing a service, a confirmation email will be sent to the Seller.

For payment information, refer to the section above titled "How to Make Payments."

16. Authentication & Warehousing Terms

What is Authentication?

To ensure trust and quality, Cycle of Samsara offers authentication for luxury and high-value fashion items through Legit Grails. This service guarantees that buyers receive genuine products while helping sellers build credibility. Please note that only buyers can utilize the verification service when purchasing an item; sellers cannot purchase this service for their own items.

How It Works

When can the service be used?

To be eligible for verification, a listing must meet all of the following criteria:

  • Brand: (refer to the Legit Grails list of brands)
  • Category: Clothing, bags, accessories, jewellery, or shoes

If a buyer opts to use the service and pays for it when purchasing an item, the seller will receive a notification. Once an item is marked as eligible for verification, sellers cannot remove the verification option from their listing.

How does it work?

The service fee for any item will be shown to the buyers on the item page. The fee consists of the verification service charge and shipping costs from the seller's address to the verification hub. The shipping cost from the verification hub to the buyer is covered by a standard shipping fee that buyers will see at checkout.

If an item is purchased with the verification service:

  1. The seller will receive a prepaid shipping label generated by us, addressed to our verification hub in Kolkata. Once the item is purchased, the seller has 5 business days to ship it to us.
  2. After we receive the item, our team of experts will usually check its authenticity within 3-4 business days.
  3. This check is based on objective criteria, including information about authentic brand products and documents provided by the seller.
  4. If the item is successfully verified, we will ship it to the buyer within 4-5 business days (along with the inspection label).

When buying from a standard seller:

  • If the buyer notices any issues with the item, they should press the "I have an issue" button in the conversation screen with the seller and submit a claim. We will investigate, and if we deem the claim to be valid, we may ask the buyer to return the item to the hub for a second check.
  • If the buyer does not raise a claim within 5 calendar days, the order will be considered complete, and the seller will receive their earnings. The same applies if the buyer confirms that everything is okay.

For Buyers:

The buyer pays the authentication fee upfront when purchasing this additional service for a luxury item.

  • If the item passes authentication, it will be shipped directly to the buyer.
  • If the item fails authentication, the buyer will receive a full refund, and the item will not be shipped to them.

For Sellers:

The seller is responsible for ensuring that all listed items are genuine.

If an item fails authentication, the seller must:

  • Pay a failed authentication penalty to compensate for time and verification resources.
  • Pay a return shipping fee if they wish to have the item returned to them.

Alternatively, the seller may choose to forfeit the item, which will be responsibly discarded or donated and their listing will be taken down.

Warehousing & Storage

Once authenticated, the item is stored at our warehouse until it is shipped to the buyer.

If the item fails authentication, it will remain at the warehouse until the seller chooses either to return it or forfeit it.

If the seller fails to respond within a specified period, the item will be considered forfeited.

Buyer Protection & Trust

Every authenticated product sold on our site comes with a guarantee of authenticity.

Buyers can scan the QR code linked to the verification certificate for confirmation.

Fraud Prevention & Penalties

Submitting counterfeit items may result in a penalty fee and account suspension.

Repeated violations will lead to a permanent ban from the platform.

By using our authentication service, both buyers and sellers agree to these Authentication & Warehousing Terms.

17. Shipping

Shipping Costs

Prepaid Shipping fees vary based on parcel size, shipping route, carrier, and applicable discounts. Shipping costs will be displayed before checkout.

Tracking Parcels

  • Buyers can track their parcels using information provided by the carrier.
  • We shall not be liable for inaccurate or incomplete tracking updates from carriers.

Responsibilities

  • Sellers: Must comply with packaging rules and the forbidden items list. Sellers failing to comply may forfeit refund or compensation eligibility.
  • Buyers: Must ensure correct delivery addresses.

Lost or Damaged Parcels

  1. For Prepaid Shipping:
    • The Buyer will receive a refund under the Refund Policy if the parcel is lost or damaged.
    • The Seller will receive compensation from us based on carrier rules.
  2. For Non-Prepaid Shipping:
    • The Seller assumes responsibility for lost or damaged parcels and must claim compensation directly from the carrier.

18. Payments and Payouts

Buyer Approval

Buyers have 5 days after delivery to approve a purchase. If no action is taken, funds are automatically released to the Seller.

Seller Payouts

  • Sellers receive payouts after Buyer confirmation.
  • Funds are credited to the Seller's wallet and can be withdrawn to their bank account within 3–4 working days.

Platform Fee

We may charge a small platform fee for every transaction to ensure smooth operations.

19. Disputes and Resolutions

Handling Disputes

  • We mediate disputes between Buyers and Sellers.
  • Both parties must provide supporting evidence to resolve the dispute.

Final Decision

  • Our decision in dispute cases is final and binding.

20. Prohibited Activities

The following activities are strictly prohibited by us:

  • Listing counterfeit, stolen, or prohibited items.
  • Misusing the platform for fraudulent or illegal activities.
  • Violating intellectual property rights.

Violators may face account suspension or permanent banning.

21. What You'll See on Our Site

Ownership of the Site

  • Cycle of Samsara, along with its affiliates and licensors, owns all intellectual property rights to the Site, including its system, layout, software, trademarks, and domain names.
  • Users may not use any of our intellectual property without prior written consent.

Guarantee of Conformity

  • If you live in India, you benefit from a legal guarantee of conformity for digital services.
  • We would be liable is liable if:
    • The digital service does not conform at the time of provision.
    • Non-conformities arise within two years of continuous use.
  • To make a claim, follow the steps outlined in "How Disputes Will Be Handled."

Site Availability

We strives to minimize service disruptions, but we are not responsible for interruptions caused by:

  • Maintenance.
  • Events beyond our reasonable control.

When such events occur, We will:

  • Inform Users about planned or existing availability restrictions.
  • Schedule downtime outside peak usage hours whenever possible.
  • Limit downtime to a reasonable amount consistent with market standards.

22. What You and We Are Responsible For

Your Responsibilities

When using our Site and Services, you are responsible for:

  • The accuracy of your Content and any actions taken under your Account.
  • Ensuring the Items you list, sell, and transfer to Buyers meet legal and platform requirements.
  • Any disputes that result from your actions.
  • Published reviews.

Taxes

  • We are not responsible for any tax liabilities or reporting obligations arising from your activities on the Site.

Hosting Provider

We act as a hosting provider, facilitating transactions between Buyers and Sellers.

  • We do not monitor all Content or Items listed on the Site.
  • We are not liable for losses or damages related to a Transaction unless explicitly covered under Buyer Protection, these Terms, or other legal obligations.

23. User Responsibilities

  • Users must use the Site for lawful purposes only.
  • Users are prohibited from:
    • Engaging in fraudulent transactions, money laundering, or harassment.
    • Selling counterfeit, illegal, or hazardous items.
    • Violating intellectual property rights.

24. Cancellation Policy

For Buyers

  • Orders can be canceled before shipping.
  • Once shipped, cancellations are no longer valid, and the standard return policy applies.

For Sellers

  • Sellers cannot cancel an order once it is placed unless there is an issue with the Item (e.g., damage).

25. Restricted Items

The following items cannot be listed on our site:

  • Counterfeit or stolen goods.
  • Intimate apparel or swimwear unless tagged and unworn.
  • Items promoting hate speech, violence, or illegal activities.
  • Hazardous materials.

26. Inactive Accounts

  • We reserve the right to deactivate or delete accounts inactive for more than 24 months without prior notice.
  • Wallet balances associated with inactive accounts must be claimed before deactivation.

27. Promotional Offers

  • Discounts, promotional credits, or other offers are subject to expiration dates and specific conditions.
  • Promotional credits are non-transferable and cannot be exchanged for cash.

28. Force Majeure

  • While we will assist in resolving disputes related to third-party services, we are not responsible for issues caused directly by these third parties.

31. Wallet Expiration

  • Funds in a User's wallet that remain unclaimed for 12 months may expire.
  • We shall provide prior notice before wallet balances expire.

  • Disputes between Buyers and Sellers unless explicitly covered under Buyer Protection.
